Legal Comments

The following terms and conditions regulate the user’s utilisation of the respective web site and are acknowledged when the user uses the web site for the first time. The Schwartauer Werke GmbH & Co. KGaA Company shall hereafter be referred to as “Schwartau”, visitors to the web site as “Users”.

1. Content

All content which is made available to the User on Schwartau’s sites have been compiled with the utmost of care. Nevertheless, Schwartau shall be liable for the correctness, completeness and reliability of content only in the event that it has committed gross negligence or intentional wrongdoing which results in any losses or damages which the user may suffer owing to, among other reasons, the fact that the user has relied upon information which he has received during the course of his use of the service. The entire content of all of Schwartau’s sites is protected by copyright. The user of Schwartau’s sites has no authorisation to reproduce, publish or disseminate the content in electronic or printed form without Schwartau’s express consent.

2. Interactive services

When utilising interactive services, the User is obliged to publish no contributions which violate the laws of the Federal Republic of Germany or misuse Schwartau’s server. The User is likewise responsible for ensuring that the data that he uploads or which are uploaded while using his access code do not morally endanger underage users of Schwartau’s sites.

The user must show consideration for the cultural and religious opinions/beliefs of the other users and particularly make no statements which are hurtful, offensive, defamatory, threatening, obscene or otherwise illegal.

3. Provision of content by the user

The User shall be responsible for ensuring that no data are uploaded by him or while using his access code whose publication or dissemination violates licensing provisions or German or foreign rights of authorship, copyrights or trademarks. He acknowledges that the damaged party may ask for the prosecution of any violations under criminal law. The required documents shall be made available in order to ascertain which party has caused the damages. Insofar as the User supplies content to the web site whose use and dissemination the owner of this content has approved, he shall likewise grant Schwartau the right to disseminate this content via the Schwartau server or other media.

4. Availability of products and services

Because Schwartau’s web sites display international content, we wish to point out to our users that not all products / services displayed on Schwartau’s web sites are mandatorily available in your country. In cases of doubt, please send an e-mail to: info@schwartau.de

5. Schwartau’s liability

Schwartau shall not be liable for content and programmes that are offered by third parties on the web site, on the Internet or in additional networks which are not affiliated with Schwartau and not for damages which are created from them unless these damages have been caused by Schwartau through its gross negligence or intentional wrongdoing or through its violation of essential obligations of this agreement owing to its gross negligence or intentional wrongdoing. Schwartau’s sites may contain links to external web sites. Visiting this web site occurs at the visitor’s own risk. Schwartau is not responsible for technical or content-related concerns involving these third-party web sites.

6. Access to password-protected / secure areas

Access to password-protected and/or secure areas on all of Schwartau’s web sites is permitted exclusively to authorised users. Schwartau reserves the right to take all legal steps against persons who attempt to gain access to these areas without having received express consent to do so.

7. Transmission / saving of personal user data

Schwartau shall keep confidential all data about or from the users that have been collected or transmitted via the web site. Schwartau assumes no responsibility whatsoever for the content of messages sent to Schwartau or contributions made in public / restricted areas of Schwartau’s servers.

This web site uses Google Analytics, a Web analysis service of Google Inc. (“Google”). Google Analytics uses so-called “cookies”, text files which are saved upon your computer and which make it possible to analyse your use of the web site. The information about your use of this web site (including your IP address) which is created through the cookie shall be transmitted to one of Google’s servers in the USA and saved there. 8. Commissioning of third parties

Schwartau shall be entitled to commission third parties to render the services it owes and to collect the payments to be rendered by the User in accordance with the Usage Agreement.

9. Assignment of the rights and obligations from this agreement

Schwartau shall be entitled to assign the rights and obligations from this agreement to third parties without being required to make separate notification of this.

10. Registered trademarks

All registered or unregistered trademarks are the property of Schwartauer Werke GmbH & Co. KGaA or the respective holder of the rights.

11. Amendments of and supplements to individual terms and conditions

Amendments of and supplements to individual usage terms and conditions shall not be specially announced by Schwartau and shall become immediately effective.

12. Supplemental clause – “Liability for links”

The aforementioned company provides no guarantees that the information and offers upon Schwartau’s servers are complete and correct. The reproduction or incorporation of the entire offer or parts thereof is permitted only with Schwartau’s consent.

Through the ruling of 12 May 1998 (File 312 O 85/98 – “Liability for links”), the Regional Court of Hamburg ruled that, where applicable, if one creates a link to one’s own web site, one must also share responsibility for the content of the linked page. This may – according to the court – only be prevented if one expressly distances oneself from this content. Because we have no control over the layout and content of the linked pages, we expressly distance ourselves from all content on all linked pages and declare that the content of the linked pages is not our own. This declaration shall not be valid for all accessible links on this server.

13. Applicable law, place of performance

This agreement shall be subject to the law of the Federal Republic of Germany. The place of performance shall be Bad Schwartau. As of: 01/03/2010
